A. |
|
MARE
OWNER'S RESPONSIBILITIES |
| |
1. |
Mare
owner agrees to supply the correct name and TWHBEA
registration for each mare bred. Any charges
resulting from the failure to do so will be expensed
to the mare owner. |
| |
2. |
Mare
owner warrants that the mare being bred is healthy,
in sound breeding condition, and free from infection
or disease. In the event the mare should have
an infection, stallion owner is authorized to obtain
veterinarian care prior to breeding, at mare owner's
expense. |

3. |
Mare
owner agrees to pay all fees and related breeding
expenses promptly. |

| B. |
|
FEES AND EXPENSES |
| |
2. |
A non-refundable
breeding fee of $500.00 is to be received prior to
the breeding process. Mare
care - $12.00 per day. |
|
|
C. |
|
BREEDING SERVICES |
| |
1. |
Mares that do not
have a current negative intrauterine status will be
bred unless the veterinarian advises otherwise, and
if necessary, appropriate treatment will be
administered before the mare will be rebred, at the
expense of the mare owner. If the mare fails
to conceive after exposure through 2 breeding
cycles, the mare owner will be contacted to discuss
future proceedings. |

2. |
Stallion owner
shall not be liable for any death, sickness, injury
and/or accident, including consequential damages to
the mare and/or foal. The mare owner
understands, authorizes, and assumes the special
risk inherent in the procedures and process of
artificial insemination and its many variables.
The mare owner agrees to hold stallion owner
harmless for any and all damages, losses and/or
expenses associated herewith. |

MARE
SUBSTITUTIONS |

The mare owner
may substitute a different mare other than the one
designated in this contract with the express written
consent of Magnolia Farms. A substitute mare
is subject to the same provisions as the mare
originally designated in this contract and assumes
on the remaining portion of any time limitations
specified in this agreement. |

E. |
|
LIMITED LIVE FOAL GUARANTEE |
| |
1. |
Should the mare fail to
produce a live foal, the mare owner shall be
entitled to return privileges for re-breeding for a
period of 1 year from the initial date of breeding.
There will be no additional fee for re-breeding
during this time period, but all related expenses
will apply. |

2. |
Failure to promptly notify
stallion owner of the mare aborting/absorbing,
failure to conceive, or death of the foal shall
result in loss of return breeding privileges and the
live foal guarantee. The status of the mare
should be reported to stallion owner within 90 days
of the last breeding date. |

3. |
The mare owner shall notify
stallion owner of the birth of the foal within 10
days of the birth. Stallion owner will
promptly have a signed application for registration
to the designated mare owner, providing that all
fees have been paid and the account is in good
standing. |

4. |
The mare owner accepts, that
in the event of death, or the incapacity of the
stallion to breed, that all fees are forfeited in
such an event that is out of the control of the
stallion owner. |
